Res. 36] The Committee on Rules, having had under consideration House Resolution 36, by a nonrecord vote, report the same to the House with the recommendation that the resolution be adopted. BRIEF SUMMARY OF PROVISIONS OF RESOLUTION The resolution provides for consideration of H.R. 350, the Mandates Information Act of 1999, under an open rule providing one hour of general debate equally divided and controlled by the chairman and ranking minority member of the Committee on Rules. The rule waives points of order against consideration of the bill for failure to comply with clause 4(a) of rule XIII (requiring a three day layover of the committee report) and section 306 of the Congressional Budget Act (prohibiting consideration of legislation within the Budget Committee's jurisdiction, unless reported by the Budget Committee). The rule considers the amendment in the nature of a substitute recommended by the Committee on Rules, now printed in the bill, as an original bill for the purpose of amendment which is considered as read. The rule also waives points of order against the amendment in the nature of a substitute for failure to comply with section 306 of the Congressional Budget Act. The rule further allows the chairman of the Committee of the Whole to accord priority in recognition to those members who have preprinted their amendments in the Congressional Record prior to their consideration. The rule also allows the chairman of the Committee of the Whole to postpone recorded votes and to reduce to five minutes the voting time on any postponed question, provided voting time on the first in any series of questions is not less than fifteen minutes. Finally, the rule provides one motion to recommit, with or without instructions. The waiver of clause 4(a) of rule XIII is necessary because the report was filed Tuesday, February 2, and the bill is expected to be considered on the House floor on Thursday, February 4. Consequently, the report will only be available for 1 day. The waiver of section 306 of the Congressional Budget Act is necessary because the bill and the amendment in the nature of a substitute both include amendments to the Budget Act which is a shared jurisdiction between the Rules Committee and the Budget Committee. However, the bill was actually only referred to the Rules Committee.
