Union Calendar No. 601 110th Congress Report HOUSE OF REPRESENTATIVES 2d Session 110-928 ====================================================================== ACTIVITIES AND SUMMARY REPORT OF THE COMMITTEE ON THE BUDGET _______ January 2, 2009.--Committed to the Committee of the Whole House on the State of the Union and ordered to be printed _______ Mr. SPRATT of South Carolina, from the Committee on the Budget, submitted the following REPORT Jurisdiction and Functions of the Committee The Committee on the Budget was established by the Congressional Budget Act of 1974. The Budget Committee is responsible for developing and reporting the annual congressional budget resolution, assembling and reporting any reconciliation legislation required by that resolution, and implementing and governing the congressional budget process generally. The budget resolution, the cornerstone of the congressional budget process, provides an overall framework and plan for action on spending, revenue, and debt limit legislation. It sets ceilings on total budget authority and outlays and a floor on total revenues. It also allocates spending authority to the appropriations committees and among the various authorizing committees that have jurisdiction over direct spending programs. The limits and allocations set by the budget resolution are enforced through points of order. The budget may also include the optional reconciliation process, which directs appropriate authorizing committees to revise programs under their jurisdiction in order to adjust either projected spending or revenues by specified amounts. If more than one committee receives reconciliation instructions, the Budget Committee is responsible for assembling the reports submitted by the various committees for consideration on the House floor. In addition to its legislative duties, the Budget Committee also has responsibility for oversight and studies related to the budget process. The Budget Committee's jurisdictional statement for the 110th Congress, House Rule X, clause 1(d), is as follows: (1) Concurrent resolutions on the budget (as defined in section 3(4) of the Congressional Budget Act of 1974), other matters required to be referred to the committee under titles III and IV of that Act, and other measures setting forth appropriate levels of budget totals for the United States Government. (2) Budget process generally. (3) Establishment, extension, and enforcement of special controls over the Federal budget, including the budgetary treatment of off-budget Federal agencies and measures providing exemption from reduction under any order issued under part C of the Balanced Budget and Emergency Deficit Control Act of 1985. Summary of Activities FISCAL YEAR 2008 BUDGET CYCLE On March 21, 2007, the House Budget Committee began consideration of House Concurrent Resolution 99 (H. Con. Res. 99), the concurrent resolution on the budget for fiscal year 2008, with markup of the Chairman's mark. Of the twenty-nine amendments offered, three were adopted. The Committee agreed by voice vote to a Sense of House amendment offered by Mr. Ryan and Ms. Moore on the need for legislative action to ensure child support collection and compliance. The Committee also agreed by voice vote to a Sense of House amendment offered by Mr. Garrett and Mr. Edwards on providing plot allowances to states for the burial of veterans' spouses and eligible children in state veteran cemeteries. In addition, the Committee agreed by voice vote to an amendment offered by Mr. Etheridge to include policy language on college affordability. By a vote of 22 to 17, the Budget Committee reported H. Con. Res. 99 favorably to the House of Representatives and the report accompanying the concurrent resolution, House Report 110-69, was timely filed. The Committee on Rules reported H. Res. 275, a rule allowing consideration of H. Con. Res. 99 on March 27, 2007 (House Report 110-79). The rule provided for four hours of general debate, with three hours controlled and equally divided by the Chairman and Ranking Member of the Budget Committee and one hour controlled and equally divided by Ms. Maloney and Mr. Saxton of the Joint Economic Committee. The rule also allowed for consideration of three alternative budgets: the Congressional Black Caucus substitute offered by Ms. Kilpatrick; the Progressive Caucus substitute offered by Ms. Woolsey; and the Republican substitute offered by Mr. Ryan. The House adopted H. Res. 275 on March 28, 2007. Pursuant to H. Res. 275, the House began consideration of H. Con. Res. 99 on March 28, 2007. All three budget substitutes made in order were defeated on recorded votes. H. Con. Res. 99 was agreed to by a vote of 216 to 210 on March 29, 2007. On March 16, 2007, the Senate Budget Committee reported as an original measure on the fiscal year 2008 budget Senate Concurrent Resolution 21 (S. Con. Res. 21). The resolution, as amended, was agreed to in the Senate on March 23, 2007, by a 52 to 47 vote. The House received the message on Senate action March 28, 2007. The Committee on Rules reported H. Res. 370, a rule providing for consideration of S. Con. Res. 21 on May 3, 2007 (House report 110-121). The rule made it in order for the House to strike all after the resolving clause of S. Con. Res. 21 and insert the text of H. Con. Res. 99 as adopted by the House. In addition, the rule made it in order for the House to insist on its amendment and request a conference with the Senate. On May 8, 2007, the House passed H. Res. 370. The House then agreed to strike all after the resolving clause of S. Con. Res. 21 and insert the provisions of H. Con. Res. 99, insisting on its amendment and requesting a conference with the Senate. The House then considered and agreed to a motion to instruct conferees on. S. Con. Res. 21 that was offered by Mr. Ryan, and the Speaker appointed conferees. The Senate received the message on House action on May 8, 2007. On May 9, 2007, the Senate disagreed with the House amendment and agreed to a request for a conference. Also on May 9, 2007, the Senate considered motions to instruct conferees and appointed conferees. The message on Senate action was sent to the House on May 10, 2007. The conference report on S. Con. Res. 21 (House Report 110- 153) was filed May 16, 2007. The Committee on Rules reported H. Res. 409, a rule providing for the consideration of the conference report on S. Con. Res. 21 that allowed one hour of debate time. On May 17, 2007, conference papers (including Senate report language, the manager's statement, and a message on House action) were held at the Senate desk. The House passed H. Res. 409 and, by a 214 to 209 vote, adopted the conference report. The Senate agreed to the conference report by a 52 to 40 vote. FISCAL YEAR 2009 CYCLE On March 5, 2008, the House Budget Committee began consideration of House Concurrent Resolution 312 (H. Con. Res. 312), the concurrent resolution on the budget for fiscal year 2009, with markup of the Chairman's mark. Of the thirty-one amendments offered, one was adopted. The Committee agreed by voice vote to a Sense of House amendment offered by Mr. Ryan and Ms. Moore on the importance of ensuring that children receive all the child support that is owed to them. By a vote of 22 to 16, the Budget Committee reported H. Con. Res. 312 favorably to the House of Representatives and the report accompanying the concurrent resolution, House Report 110-543, was timely filed. The Committee on Rules reported H. Res. 1036, a rule allowing consideration of H. Con. Res. 312 on March 11, 2008 (House Report 110-548). The rule provided for four hours of general debate, with three hours controlled and equally divided by the Chairman and Ranking Member of the Budget Committee and one hour controlled and equally divided by Ms. Maloney and Mr. Saxton of the Joint Economic Committee. The rule also allowed for consideration of three alternative budgets: the Congressional Black Caucus substitute offered by Ms. Kilpatrick; the Progressive Caucus substitute offered by Ms. Lee; and the Republican substitute offered by Mr. Ryan. The House passed H. Res. 1036 on March 12, 2008. Pursuant to H. Res. 1036, the House began consideration of H. Con. Res. 312 on March 12, 2008. All three budget substitutes made in order were defeated on recorded votes. H. Con. Res. 312 was agreed to by a vote of 212 to 207 on March 13, 2008. On March 7, 2008, the Senate Budget Committee reported as an original measure on the fiscal year 2008 budget Senate Concurrent Resolution 70 (S. Con. Res. 70). The resolution, as amended, was agreed to in the Senate on March 14, 2008, by a 51 to 44 vote. The House received the message on Senate action March 31, 2008. The Committee on Rules reported H. Res. 1190, a rule providing for consideration of S. Con. Res. 70 on May 13, 2008 (House Report 110-630). The rule took up S. Con. Res. 70 and did the following: adopted an amendment in the nature of a substitute consisting of the text of H. Con. Res. 312, as adopted by the House; adopted such Senate concurrent resolution as amended; insisted on its amendment; and requested a conference with the Senate. On May 14, 2008, the House passed H. Res. 1190. The House then considered and defeated a motion to instruct conferees on S. Con. Res. 70 that was offered by Mr. Ryan, and the Speaker appointed conferees. The Senate received the message on House action on May 14, 2008. On May 15, 2008, the Senate disagreed with the House amendment and agreed to a request for a conference. Also on May 15, 2008, the Senate considered motions to instruct conferees and appointed conferees. The message on Senate action was sent to the House on May 16, 2008. The conference report on S. Con. Res. 70 (House Report 110- 659) was filed May 20, 2008. The Committee on Rules then reported H. Res. 1214, a rule providing for the consideration of the conference report on S. Con. Res. 70 that allowed one hour debate time. H. Res. 1214 passed the House on May 21, 2008. On June 3, 2008, conference papers (including Senate report language and the manager's statement) were held at the Senate desk. The Senate agreed to the conference report by a 48 to 45 vote on June 4, 2008. On June 5, 2008, the House adopted the conference report upon a 214 to 210 vote. Additional Matters Related to Budget Activities H. RES. 6 H. Res. 6 is the resolution the House of Representatives considered in adopting rules for the One Hundred Tenth Congress. The resolution contains several new budget enforcement provisions that were adopted in addition to standard House rules on budget process. The enforcement provisions are included in House Rule XXI. Clause 7 of House Rule XXI provides that reconciliation directives included in a budget resolution under the Congressional Budget Act of 1974 (CBA) shall not increase a deficit or decrease a surplus. Clause 8 of House Rule XXI provides that, with respect to measures considered pursuant to a special order of business, points of order under the CBA shall operate without regard to whether the measures concerned have been reported from a committee. Clause 10 of House Rule XXI consists of a Pay-As-You-Go (PAYGO) rule requiring that mandatory spending increases and revenue decreases be offset over a six-year and 11-year period. H. Res. 6 also included separate orders relating to budget process under section 511 of the resolution. Section 511 provides that references to resolutions in section 306 of the CBA shall apply to only joint resolutions (not simple or concurrent resolutions). Section 511 also provides that a point of order under section 303 of the CBA is applicable to text made in order as an original bill by a special rule, or to the text on which the previous question is ordered, whichever the case may be. Pursuant to section 511, the concurrent resolution on the budget for fiscal year 2007, H. Con. Res, 376, remained in effect until the fiscal year 2008 budget was adopted. The section also required the Chairman of the Budget Committee (when elected) to print in the Congressional Record both committee allocations for the fiscal year 2008 budget and accounts identified for advance appropriations as referred to in H. Con. Res. 376 (109th Congress). BUDGET ENFORCEMENT ACTIVITIES The committee worked with authorizing committees and the Appropriations Committee to monitor legislation and evaluate its compliance with House rules and the budget resolution. OVERSIGHT ACTIVITIES Under clause 1(d)(1) of House Rule X, a primary responsibility of the Budget Committee is the development of a concurrent budget resolution that sets spending and revenue levels in aggregate and across all budget functions. The budget functions encompass all Federal programs or activities other than those that are defined as off-budget, such as Social Security and the Postal Service, and those that are considered non-budgetary, such as the Federal Reserve. The committee's formal oversight responsibility focuses on law governing the budget process and the agencies responsible for administering elements of those laws. Under clauses 1(d)(2) and (3) of House Rule X, the major laws falling within its oversight are the Budget and Accounting Act of 1920, the Congressional Budget Act of 1974, and the Emergency Balanced Budget and Deficit Control Act of 1985. The two agencies with primary responsibility for administering elements of these laws, and hence which fall under the committee's jurisdiction, are the Office of Management and Budget and the Congressional Budget Office. In addition to these general oversight responsibilities, the Budget Committee has special oversight responsibility under clause 3 of House Rule X to study the effect of budget outlays of existing and proposed legislation and to request and evaluate continuing studies of tax expenditures. The committee met on January 18, 2007, to organize for the 110th Congress. In addition to adopting rules of procedure for the committee, the committee adopted a written oversight plan. The priorities of the oversight plan included holding hearings and receiving testimony from Members of Congress, Cabinet-level and other Federal officials, State and local officials, and expert witnesses to review the President's budget submissions and other alternatives to programs and activities; studying the budgetary effect of existing law and proposed legislation, as well as government regulation, on government spending; and reviewing views and estimates submitted by committees in development of the concurrent resolution on the budget. With regard to budget enforcement, the oversight plan called on the committee to conduct ongoing oversight of the Office of Management and Budget's budget activities under the Budget and Accounting Act of 1920, the Congressional Budget Act of 1974, the Balanced Budget and Emergency Deficit Control Act of 1985, the Budget Enforcement Act of 1990, and other applicable laws. The oversight plan also outlined the necessity of studying federal direct spending and tax incentives policies and the effect those policies have on the Federal budget. The Budget Committee's oversight plan proposed a total of 26 hearings for the 110th Congress. The Committee exceeded this plan by holding a total of 43 hearings for the 110th Congress.
