I. INTRODUCTION

As a service to coastal residents, the Alabama Coastal Area Board has
established a Permit Information Center at its office in Daphne. Coastal Area
Board staff are available to assist coastal residents in filling out and pro-
cessing permit applications. Permit applications for all local, state, and
federal agencies who issue permits are on file at the Coastal Area Board Office
along with each agency's rules and regulations and other pertinent informa-
tion.

This booklet provides general information to the permittitig process for
some of the more common activities conducted within Alabama's two coastal
counties with special emphasis on those permits which may be required within
the Coastal Area. For example, if you wish to construct a house, the discus-
sion on page 2 provides a brief description of the steps you should follow
to obtain the necessary permits, who to contact, permit fees, and an estimate
of how long it would take to obtain the permit. For further information

II. CONSTRUCTION OF A HOUSE

A. General

If you plan to construct a HOUSE, you must obtain a BUILDING PERMIT
from the building inspector in the municipality where you plan to build.
If you live outside the municipal limits of a city, you must obtain a
BUILDING PERMIT from the building inspector in the county where you plan
to build. The building inspector will review your plans for compliance with
the adopted building codes and zoning ordinances. Table I presents a
listing of municipalities and counties with adopted building codes or
zoning ordinances.

Building permits may usually be obtained within fday. Permit fees
vary within the different municipalities but are generally assessed according
to the valuation of the construction. The permit fee must be paid when
the permit application is filed. Table 2 on page 3 presents a listing of
building inspectors for the counties and municipalities within the Coastal
Area.

B. Construction in a Floodplain

If you plan to build within the floodplain, you are subject to flood
insurance regulations. The building inspector or the adviser at the Permit
Information Center can tell you if your lot is located within the floodplain.
The building inspector for each county or city will review your plans for
compliance with the flood insurance regulations prior to issuing a BUILDING
PERMIT.

The application for this permit will be reviewed based on the impact of the
construction on the wetlands. This process will take a minimum of 45 days,
but the normal time period would be about 90-120 days. If the permit
application is approved, an application fee of $10 must be paid for a non-
commercial activity.

D. Construction of a Septic Tank for Waste Disposal

If you plan to build a septic tank, you must obtain a permit from the:

You must submit an Individual Water Supply and Sewage Disposal Report
and percolation test prepared by an engineer or surveyor to the County Health
Department. This report will contain the necessary information for the County
Health Department to determine whether to approve installation of a septic
tank.

The County Health Department will inspect the system. If the required
standards are met, the inspector will submit a report, and the County Health
Department will issue a permit. There is no permit fee in Baldwin County,
and the fee in Mobile County varies ($13 average) depending on.the size and con-
struction of the system. This permit procedure normally takes about two weeks.

E. Construction of a Private Water Well Supply

If you plan to construct a water well, the drilling must be performed
by a licensed well driller. At least three days before construction of the
well, the driller must file a notification with the:

The County Health Department is responsible for inspecting the well
and sending notification to the ALABAMA WATER WELL STANDARDS BOARD. There
is no permit fee.

Within 30 days of completion, the licensed well driller must file a
Report of Drilled Wells with the:

III. DEVELOPMENT OF A SUBDIVISION

A. Approval of a Subdivision Plat

To develop a SUBDIVISION, you must obtain approval from the PLANNING
COMMISSION with jurisdiction in the area where you plan to build. Jurisdic-
tion over subdivisions extends 5 miles beyond the municipal limits of each
town, and you should consult the zoning ordinances and subdivision regula-
tions for the area you plan to develop. Table 3 presents a listing of those
municipalities and counties with adopted subdivision regulations.

Normally, the Planning Commission may be contacted through the City
Clerk. In Baldwin County and in the City of Mobile, contact the Planning
Commission directly. Contact persons for obtaining approval to develop a
subdivision are listed on Table 4 on page 7.

To obtain approval to develop a subdivision you must first file a
preliminary plat along with an application for approval at least 20 days
before a meeting of the Planning Commission. This plat will be considered
by the Planning Commission, and a public hearing will be held to receive
comments about the application. The costs and time for obtaining approval
for development of a subdivision may vary depending on many factors such as
location, size, number of houses, etc.

Approval of the preliminary plat will allow you to proceed with improve-
ments to the subdivision. Within one year of preliminary approval, an
application for approval of a final plat must be filed. After approval of the
final plat, the subdivision plat should be filed with the Probate Judge.

In unincorporated areas of Mobile County that are 5 miles beyond any
municipal limits, the County Engineer will inspect the subdivision after
installation of paved streets and a drainage system. He will make recoimnenda-

tions to the Mobile County Commission. If the Commission approves, then
the County Engineer must sign the subdivision plat before it can be recorded
with the Probate Judge.

is located within the Coastal Area, you must submit an erosion control plan,

describing the Best Management Practices which will be used for controlling
runoff from construction and development, to:

C. Construction in Wetlands

If you plan to develop so as to affect any WETLANDS or MARSH SYSTEM, you

Any wetland construction involving dredging and removal of sand, gravel,
oyster shell, fill or other bottom material from state owned water bottoms
requires a lease/contract from the State Lands Division of the Department of
Conservation and Natural Resources, for which a royalty-type charge is made.

D. Subdivision Water Supply and Sewage Disposal

1. Use of Existing Public Water Supply and Sewage Disposal System

If the subdivision will be located within the subdivision jurisdiction
of a municipality where existing public water supply and Sewage disposal
systems are available, then obtain a letter from the municipal water and
sewer department stating that the municipality will provide these services.
The areas of subdivision jurisdiction usually extend 5 miles outside the
municipal limits.

If the subdivision is located outside of the subdivision jurisdiction
of a municipality, then approval to use an existing public system must be

obtained from the ALABAMA DEPARTMENT OF PUBLIC HEALTH, acting through the
COUNTY HEALTH DEPARTMENT.

An engineer must complete a Preliminary Subdivision Water Supply and
Sewage Disposal Report, and submit it along with a vicinity map, results
of soil survey, area boundary plat, and other necessary information to:

This report will be reviewed and sent to the ALABAMA DEPARTMENT OF PUBLIC
HEALTH, who will make recommendations back to the COUNTY HEALTH DEPARTMENT.
There is no permit fee in Baldwin County, and the fee in Mobile County
varies depending on the system.

The final report should be submitted to the COUNTY HEALTH DEPARTMENT,
as noted above. They will review the report, inspect the site, and send
recommendations to the ALABAMA DEPARTMENT OF PUBLIC HEALTH. If this
department approves, the COUNTY HEALTH OFFICER is authorized to sign the
final subdivision plat before it is recorded with the Probate Judge. No
permit fee is charged for this permit.

2. Construction of a New Private Water Supply and SewaZe Disposal System

If you plan to construct a public water supply and sewage treatment
facility, you must obtain approval from the Alabama Department of Public
Health acting through the COUNTY HEALTH DEPARTMENT. Contact the:

The Coastal Area Board and the Geological Survey of Alabama will review the
data provided by the user and other available data to identify potential
saltwater encroachment problems associated with the proposed well. There is
no fee, and the process normally takes less than 30 days.

If the sewage treatment facility involves a discharge of wastewater to
Alabama waters, you must obtain a permit for that discharge from the:

After the DEPARTMENT OF PUBLIC HEALTH approves the system, the subdivision
plat may be signed by the County Health Officer before recording with the

3. Individual Water Wells and Septic Tanks

If you plan to rely on water wells and septic tanks for the individual
lots in a subdivision, approval must be obtained from the ALABAMA DEPARTMENT
OF PUBLIC HEALTH acting through the COUNTY HEALTH DEPARTMENT. Contact the:

A Preliminary Subdivision Water Supply and Sewage Disposal Report must
be prepared by an engineer and submitted to the COUNTY HEALTH DEPARTMENT who
will send it to the ALABAMA DEPARTMENT OF PUBLIC HEALTH. Either agency may
require percolation tests and soil bearings. There is no permit fee in
Baldwin County, and the permit fee in Mobile County may vary according to
the facility.

After you submit the final report, the COUNTY HEALTH DEPARTMENT will
inspect the site and forward recommendations to the ALABAMA DEPARiMNT OF
PUBLIC HEALTH. If the report is approved, the County Health Officer will
be authorized to sign the final subdivision plat before it is recorded
with the Probate Judge.

IV. CONSTRUCTION OF AN INDUSTRIAL FACILITY

A. General

If you plan to construct an industrial facility, you must obtain a BUILDING
PERMIT from the building inspector in the municipality where you plan to build.
If the industrial facility will be outside the municipal limits of a city, you
must obtain a BUILDING PERMIT from the building inspector in the County where
you plan to build. The building inspector will review your plan for compliance
with the adopted building codes and zoning ordinances. Table 1 on page 2 presents
a listing of municipalities and counties with adopted building codes or zoning
ordinances.

Building permits may usually be obtained within 1 day. Permit fees vary
within the different municipalities, but are generally assessed according to the
valuation of the construction. The permit fee must be paid when the permit
application is filed. Table 2 on page 3 presents a listing of building in-
spectors for the counties and municipalities within the Coastal Area.

B. Construction in a Floodplain

If you plan to build within the floodplain, you are subject to flood insur-

E. Waste Discharge

If you plan to discharge wastewater from a point source into state waters,
you must obtain a National Pollutant Discharge Elimination System (NPDES)
permit from the:

Submit the permit application to the AWIC a minimum of 180 days prior to
when you plan to begin to discharge. A14IC will issue a public notice of the
application to accept comments and may hold a public hearing. There are no
permit fees for obtaining such a permit, and the length of time for the permit
procedure may vary according to the significance of the discharge.

2. Wastewater Discharge Into a Publicly Owned Treatment Facility

Before you may discharge industrial wastewater into a publicly owned
treatment facility, you must obtain a State Indirect Discharge (SID) permit
from the:

Pretreatment of the discharge before it enters the treatment works must
meet AWIC's pretreatment regulations. There is no charge for this type of
permit.

3. Discharge from an Air Contaminant Source

V. CONSTRUCTION OF A DOCK OR MARINA

A. General

If you plan to construct a DOCK OR MARINA, you must obtain a BUILDING
PERMIT from the building inspector in the municipality where you plan to build.
If you live outside the municipal limits of a city, you must obtain a BUILDING
PERMIT from the building inspector in the County where you plan to build. The
building inspector will review your plan for compliance with the adopted
building codes and zoning ordinances. Table 1 on page 2 presents a listing of
municipalities and counties with adopted building codes or zoning ordinances.

Building permits may usually be obtained within 1 day. Permit fees vary
within the different municipalities but are generally assessed according to
the valuation of the construction. The permit fee must be paid when the permit
application is filed. Table 2 on page'3 presents a listing of building inspec-
tors for the Counties and municipalities within the Coastal Area.

B. Located in Wetlands, Dredge and Fill, or Extend into Navigable Waters

If the dock or marina will be located on or adjacent to wetlands, involve
any dredge or fill activity, or extend into navigable waters, you must obtain
a permit from the:

The CORPS will issue a public notice of the proposed project and receive
public comments. The District Engineer will prepare an environmental assess-
ment of the project. If the project will create significant impacts, an
Environmental Impact Statement (EIS) will be prepared. The EIS procedure can
add 3 to 12 months to the permit procedure, requiring preparation of a draft
EIS, public notice, public hearings, and responses from agencies and individuals.
Public hearings on the permit application may be required. If the permit is
approved, an application fee of $100 must be paid for a commercial activity
and $10 for a noncommercial activity.

If the dock or marina will obstruct navigable waters, you must obtain a
permit from the U.S. COAST GUARD. The Corps will notify the Coast Guard who will,
in turn, notify you. The Alabama Water Improvement Commission will notify you if
it needs additional information for water quality certification, and the Coast
Guard will send you the necessary permit applications if it determines that the
dock or marina should be marked with an aid to navigation.

Any wetland construction involving dredging and removal of sand, gravel,
oyster shell, fill or other bottom material from state -owned water bottoms

been followed, a temporary permit that is valid for 30 days will be issued.
There are no permit fees in Baldwin County, but the fees in Mobile County vary
depending on the size of the system, number of connections, and other factors.

Within 30 days of the final inspection, submit a final application and a

VII. CONSTRUCTION OF AN ENERGY-RELATED FACILITY

A. General

If you plan to construct an energy-related facility, you must obtain a
BUILDING PERMIT from the building inspector in the municipality where you plan
to build. If the energy-related facility will be outside the municipal limits
of a city, you must obtain a BUILDING PERMIT from the building inpsector in the
county where you plan to build. The building inspector will review your plan
for compliance with the adopted building codes and zoning ordinances. Table

with the flood insurance/tegulations prior to issuing a BUILDING PERMIT.

The Board issues permits for LP dealers, piping and appliance installation,
Bulk Storage Installation, and Meter Calibrator and/or Repairman, Complete the

October, January, April, and July.

Action on your permit application will normally be taken at the Board
