COASTAL ZONE MANAGEMENT PROGRAIi Attachment D-4 ACQUISITION PLAN LAREASIDESIGNATED FOR PRESERVATION AND RESTORATION Prepared by Strafford Rockingham Regional Council The preparation of this report was supported in part by a grant provided by the Coastal Zone Management Act of 19721, administered by the Office of Coastal Zone Management, National Oceanic and Atmospheric Administration. Introduction This plan for,the acquisition of areas designated for preservation and restoration has been completed in accordance with paragraph 2D of the contract between the Strafford Rockingham/,Regional Council and the New Hampshire Office of Comprehensive Planning, dated May 25, 1975.- Included in the development of the plan are a description of the property, reasons why acquisition or1conservation easements might be necessary, proposed ultimate uses of the property, as well as recommendations for project responsibility, estimated annual costs for FY 77-81 and possible sources of funds. Data sheets reflecting current own- ership records and calculations of estimated annual costs are included in the plan. Tracings of tax map information and sketches of each of the areas(where available) have been included in a folder accompanying this document. it should be noted that this plan is preliminary in nature. Owners have not been contacted in order to determine their willingness to either sell the property or to consent to acquisition of a conservation easement by an appropriate body. Discussions with local representatives indicate that there will be some opposition to purchase of certain parcels of land or acquisition of-easements by local or state governments. Also, significant portions of areas considered for purchase or easement serve either as prin- cipal or summer residences of the owners. There could be problems -with subdividing the land or possible owner resistance to easements or acquisition. Acquisition of significant parcels of land in any one community could cause'problems on two fronts. First, there would be a decrease in the local tax base corresponding to the value of the land acquired. This would be reflected in higher tax rates to the re- maining local residents. The possibility of transfer payments to towns in lieu of taxes on acquired properties must be considered. Further, financial responsibility for main- tenance of acquired properties must be considered. If such responsibility lies with local conservation commissions, it could result in an increase in their budgets. Again, the possibility of the transfer of funds to towns to cover such expenses might be con- sidered. The remainder of this report is divided into three sections. First, there is a method section describing the procedure involved in developing the plan as well as pro- cedures for completion of the three data sheets which form the basis of the work. Second, completed data sheets,are included in appendix form. Third, sketches of property are included in a folder accompanying one copy of this report to the Office of Comprehensive Planning in Concord. Copies of the sketches also remain at1the offices of the-Strafford Rockingham Regional Council, 99 Water Street, Exeter, New Hampshire. Method The first step in the development of this plan was to draw up a series of three data sheets which were intended to present all of the information required by paragraph 2D of the contract. Blank copies of data sheets #1, #2, and #3 are included here for reference A description of each of them follows, along with the standards used in@` filling them out. DATA SHEET NUMBER ONE This sh@et provides a brief description of each area considered for acquisition or easement as well as its location and approximate size. Reasons are given why acqui- sition or conservation easements are needed. Proposed uses of the area, recommendations for project responsibility, estimates of annual costs and possible sources'of funds complete the sheet. Areas chosen for inclusion in the plan were drawn directly from the -'.Inventory and Designation of Areas of Particular Concern"developed by Strafford..!Rockingham Regional Council during the first year coastal zone planning effort. -A later document prepared by the Strafford Rockingham Regional Council entitled "Public Actions to Bring Areas of Particular Concern Under Purview of a Management Program" (dated November'30, 1975) identified from the original inventory list those areas where conservation easements or acqui@ition ought to be considered. Standards Ose'd in,mak-ing the determinations as to whether or not to acquire or obtain easements on property are presented in that report, and reference should be made to it. Areas generally chosen for acquisition or easement included a number of individually identifiable areas not already under state or local control and with such features as rare or interesting flora and fauna, unusual" geological formations.,outstanding scenic values,or significant value to wildlife. Gen- eric categories of areas such as tidal marsh or areas of significant historical or cul- tural value were not listed here due largely to their already protected status: the wetlands are reasonably well protected by the dredge and fill law and most of the valu- able historic and cultural sites are already owned by the state, the municipality, or VO non-profit corporations whose purpose is conservation of those places. Descriptions of individual areas and reasons why acquisition or easement might be necessary are drawn from the "Areas of Particular Concern" inventory, supplemented by discussion with local interests. Proposed uses, such at for conservation land, a wild- life refuge, or a nature study area, -Wero based on the description of the property, supplemented by discussion with local representatives. Recommendations for project responsibility have been all-ocated to the public and private sectors. Most likely, there will at least be dialogue among interested parties such as between a local conservation commission and a state agency, or between a local conservation commission and the Society for the Protection of New Hampshire Forests. Cooperative efforts from the private sector in obtaining rights to desired property, @r in short-term financial assistance are also envisioned. Investigations into possible project sponsors revealed that, in the public sector,. local conservation commissions or the State of New Hampshire (most likely the Parks Division of the Department of Resources and Economic Development) would be the most logical organizations to shoulder project lead responsibility. Other state agencies, such as the New Hampshire Department of Fish and Game could also take a lead role in the acquisition of some such areas. Local conservation commissions generally have experience both in property acquisition and management, making them the obvious choice for responsibility at the local level. The most likely prospect for acquisition responsibility in the private sector is the Society for the Protection of New Hampshire Forests (SPNHF), headquartered in Concord, New Hampshire. This group has long been active in the acquisition of valuable natural areas5 and is experienced at managing them after acquisition as well. The SPNHF also works with-the Arlington, Virginia based Nature Conservancy to provide short- term loans to local conservation commissions or other entities interested in acquiring conservation land. These loans are then repaid by the borrowing entity. Thus, most of the project leadership arises at the local governmental level, even when such private organizations are involved. Project responsibility was suggested for a combination of all of the above private and public groups, a fact reflecting the diversity of organization which could shoulder the burden. In several instance.s,*(for example, the Little Harbor Islands and shore- front area),,,only public responsibility was suggested. This reflects the fact that significant use by the public-at-large is expected, and total public responsibility is warranted. I Possible sources of funds lie both in the public and the private sectors. Private sector funds are likely to arise from either the outright donation of land, from the granting of a conservation easement at no cost to the acquiring entity, or from the donation of cash to appropriate conservation organizations, such as SPNHF or local conservation commissions. Public sector funds can come from appropriations at the federal, state or local level. At the federal level, the funds now available require matching by lower govern- mental bodies. The most prominent sources are the.Bureau of Outdoor Recreation and Johnson-Dingell ("Duck Stamp") money. Both require 50% matching funds from local or state government. Local or state government may raise matching funds for appropriations -3- -through the town meeting and legislative processes respectively. They may also raise funds for outrig 'ht purchase of easements. The lure of even match money, however, has led to a number of towns in the coastal zone planning area seeking matching funds from the federal government for local projects which would otherwise probably not have been considered,. As in' the case of project management responsibility, it is entirely possible and to be expected that project financial responsibility be shared by two or more entities. This concept has long been practiced by the Society for the Protection of New Hampshire Forests and local conservation commissions. Another obvious example of joint funding is the use of state/local."match" money for federal BOR and Johnson-Dingell funds. In developing.the estimate of annual costs for FY 77-81, the goal was to spread out costs as evenly as possible over the five year period. Attention was paid to the urgency of action, also. High and low estimates of acquisition costs have been esti- mated in order to provide bounding values on.program,costs (see,discussion of Data Sheet #3). It was assumed that each area of concern would be acquired instantaneously in any given year. The year-in which the property was slated -Por acquisition was based solely on a subjective judgement of the difficulty.in obtaining title or easements on the property. Those areas with the fewest owners, and therefore deemed to be able to be acquired most easily,. were listed in the earliest years. Those areas where tax records are scanty, or which have.a complex ownership have been, wherever possible, put off un- til later in the program in order to allow time for groundwork necessary prior to the transactions. FY 77 has been considered a "negotiation" year, and no acquisition is contemplated. DATA SHEET NUMBER TWO Once the areas to be acquired or on which conservation easements might be placed were identified, ownership was identified and listed on Data Sheet #2. Information needed to complete an inventory of ownership was obtained primarily from local tax maps. Where tax maps were not available discussions with local citizens sometimes were suffi- cient to discover who the owners of affected lands were. In only one instance (Seabrook) was significant difficulty encountered in obtaining the names of owners. . Data sheet #2 records information available from individual towns. Owner's names and addresses and tax map references are listed, as well as the acreage of parcels, and the assessed values of land and improvements. Current use assessment, if any, is also listed. The type of action proposedfor-each parcel (acquisition, easement, or none) is listed in the final column. This data'is used in the calculation of program costs (see Data Sheet #3). One final.note on the type of action proposed for the individual parcels listed on Data Sheet #2: acquisition or easements of the entire parcel inventoried are not necessarily heeded. Column .#9 is the result of adding #6 and.#8. -4- -easements cannot be easily determined at this point because of the difference in de- tail of the maps,used by the Strafford Rockingham Regional Council in the development of this plan (municipal,tax maps are generally scaled at 1"=200', with no physical features shown; and the.USGS 15' series quandrangle maps, are at a scale of 1:24,000) precluding /more detailed estimates. Attempts to subdivide properties for the purpose of obtainIng conservation easements, or title, are not precise and should hot be taken as exact recommendations. DATA SHEET NUMBER THREE Data Sheet #3 is the worksheet used in calculating acquisition costs for each of the areas of particular concern. Location and name of owner information for each parcel of land to be acquired was transferred from Data Sheet #2. The remaining columns are given over to the calculation of high and low estimates of acquisition costs. Both high and low estimates of annual costs calculated on Data Sheet #3 are pre- sented on the indivi dual data sheets (#1). These reflect an upper and lower bound on program costs.. It is expected that true program costs will be somewhere in between the figure given. The assumptions which apply to each estimate are as follows: High Estimate The high estimate assumes purchase of the entire parcel on which any portion of the area of particular concern lies. (There are possible savings through the use of conservation easements, but these are not included in this estimate ). Purchase of buildings, structures and land necessary to provide ownership of the area of particular concern and immediate surroundings is assumed. (In many cases, the parcel could be subdivided and buildings not acquired. Also, land used for private dwellings, often prohibitively expensive to acquire and not crucial to success of the acquisition program, could remain in private hands.) Identifiable salt water and fresh water wetlands have been valued at their present current-use assessment. If that figure was not available, total assessed value was used. If that figure was unavailable, $100 per acre was used. All other land has been priced at the assessed value for the parcel, modified, by most recent (1975) State of New Hampshire equalized assessment ratios (see Table #1). Where assessed values were not available, estimations of value were made based on those for similar land in adjacent towns. No planning and transaction costs were included. Possible inflationary effects were ignored. Low.Estimate Conservation easements were used whenever appropriate. The cost of a conser- vation easement was estimated at various percentages of the equalized assessment. (See explanation, end of this section). Salt water and fresh water wetlands are not expected to change in value due to the effects of the New Hampshire dredge and fill law (RSA-483). Other properties,in town-may also vary fromthe average annual town- wide increase in property values. Conservation Easements The cost of acquiring a conservation easement as a percentage of fair market value varies with the development capability of the land. The following general guidelines were used in assessing the cost of acquiring an easement, both on shorefront and in- land property (reference for capability classes is made to 1:62,500 maps entitled "Land and Water Use Capability", New Hampshire Office of Comprehensive Planning, Sept-. ember 1975). The acquisition plan developed calls for these costs to be spread fairly evenly over the period FY 78-FY 81. FY 1977 has been desig- nated as a year for negotiations and staff preparations for acquisition proceedings. Virtually all areas, with the exception of those designated as deer yards, have had the high and low acquisition costs calculated for them. Only easement costs (low estimate) have been calculated for deer yards, due to their extensive nature and obviously prohibitive costs of acquisition. Some areas for which acquisition was con- sidered turned out to be largely protected. Chief among these were those areas along coastal route 1A designated as being of scenic value which were found to be included in the State of New Hampshire highway right-of-way. The Bellamy River hardwoods area in Madbury was found to be largely in University of New Hampshire hands. Certain areas in the hands of private owners, such as the Maple-Oak-Hickory forest area in Durham, .are felt to be essentially protected. However, acquisition and easement costs were calculated for these in the event that they came up for sale. The following listings (Table #2,-3) constitutes a summary of the plan for title or easement acquisition. Included in Table #2 are the areas, ordered by town, plus an indication of high and low program.costs for each area, plus the year in which action is contemplated. Total high and low costs for the entire program are tabula- ted at the.end of the table, assuming that action is taken on each property as listed. Obviously, this instance will not come to pass due to owner resistance to sell, town objectives to loss of tax base, and similar considerations alluded to earlier in the program. The sheer dollar amounts (between $1.7 and $6.4 million) needed to accomplish the program in-toto will be a limiting factor, if nothing else. Table,#3 is a summary sheet of areas to be acquired, by year, with total annual costs calculated. The Atlantic Ocean may be viewed from numerous points along coastal route 1A. Portsmouth Harbor, Little Harbor, and Hampton Harbor, along with adjacent marshlands and/or islands also provide scenery unique to the seacoast., Additional viewing is afforded by such areas as downtown Rye and Portsmouth, due to their unique architectual character. A complete list of scenic values has been presented in Strafford Rockingham Regional Council work concerning the designation of areas, of particular concern. WHY-ACQUISITION .OR CONSERVATION EASEMENTS ARE NEEDED (Copy from AREAS,OF PARTICULAR CONCERN and add to) In some instances, scenic views may be threatened by encroaching residential, commercial or industrial areas'. Purchase of lands constituting scenic areas,and surrounding them, may be necessary to preserve them for future uses. Areas requiring such action have been deemed to consist.of Little Harbor Islands and shorefront (treated separately), the Rye Harbor vicinity, and outlo.oks along.the coastal Route 1A. Most such scenic areas investigated are already in public hands. The bay,situated between tthe main stream of the Piscataqua River and the Atlantic Ocean, can be considered as part of the Piscataqua estuary or as an extension of the tidal inlet northwest of Little Harbor. The Rocky Islands and shores support heath and pines, the salt marshes support communities of spartinas and midlittoral marine algae; and the floor of the bay and channels support Eelgrass and marine algae of lower littoral and sub- littoral. Area is habitat for finfish, shellfish, heron, grebes, ducks, swans, buffleheads, goldeneyes, mer- gansers, Canada geese, the rare brant and.an occasional seal. Also serves as a major wintering area for black duck. 'WHY ACQUISITION OR CONSERVATION EASEMENTS ARE NEEDED (Copy from AREAS OF PARTICULAR CONCERN and add to) Most of the area is below mean high tide, thus state owned, but jurisdiction remaining unclear and planning nonexistent. State control is desirable as other properties are adjacent. Area is fast being subjected to development pressures such as marinas, moored barges and other commercial activities which are causing oil slicks; and land fills are destroying the productive estuarine areas. Area has high recreational potential but is neither recognized nor protected. Note: The presence of large tracts of relatively -,@ undeveloped land in the vicinity of Little Harbor, plus theirproximity to water makes this an ideal spot for expansion of state park facilities. The hiah estimate of cost reflects this though such a.project appears neither economically norpolitically feasible. Conservation easements 200' back along shorefront property on Little Harbor may serve the purpose of protecting the aesthetic value of* the area for boaters and sightseers, and 'be both politically and economically sound. This will be reflected in the low acquisition,, cott. for, the area. Extensive saltmarshes flank the-dunes on the west and north. At present the dunes are stabilized. The old blow-outs are well filled with a rich variety of plants and the more exposed crests and ridges are mostly fixed by pioneer species of sand-binding vegetation. The abundance of established plant communities on the dunes are of considerable interest. The dune hollows support a wide variety of woody plants, some of which provide a deep, summer shade underwhich grow-a variety of herbs. Red maple, black and pin cherry are common; on drier ridges and dune crests pitchpine growns with its lower branches partly buried in the sand. Bayberry, wild rose, sweet pepperbuch, poison ivy, woodbine, and dusty miller demonstrate the diversity of the environment. Aristida Tuberculosa is an abundant grass isolated here at its northern limit. This is an old millpond whose waters are controlled in an attempt to limit recreational overuse. The.draining of the pond in summer and the full water in winter and spring causes the area to vary in profile from open water to marsh around the various islands and peninsulas. Area is most important as a habitat for.Atlantic white cedar believed to be some of the largest specimens in New Hampshire with measurements raging from 18.2 inches to 22.5 inches D.B.H. The tall cedars are within 50 feet of the pond shore, the areas in between and on,the islands covered with younger cedar; large swamp extends above the pond. The constant fluctuation in water level may be destroying the trees; many have dead Lops. Areas privately owned, but essentially protected except from public overuse. Wild, undisturbed character. Longitude70 43'20"LatitUde43 02'30" Swamp Municipality Rye APPROXIMATE SIZE 70 Acres BRIEF DESCRIPTION (copy from.AREAS OF PARTICULAR CONCERN paper) This stand was clearcut about 1925 in anticipation of a housing development, but those plans were abandoned' and the cedar stand has grown back into a fine young forest, with trees reaching about 6 inch diameter. Salt- m r arsh encroaches upon the stand from the northeast, but the stand itself is growing in a fresh water swamp which has a mineral base. This is a pure cedar growth of about 25 acres and is bordered on the west and south by a mixed stand of spruce, pine and hardwood. This stand was shown on the Rye map of 1805, which may be an indication that these are the living descendents of the cedar forest which grew at nearby Odiornes Point, the remains of which are sunken and measu-red to be about 4,000 years old. The border of the saltmarsh is in fine condition. Area can be viewed from the road. This natural area has waters ranging from nearly fresh to quite brackish with associated plants ranging from fresh water to marine. One of few remaining and unspoiled tidal estuarine areas in New Hampshire and close enough to UNH to allow for instructional and research programs. A rare pondweed, the horned pondwort, grows in the estuary, and ditch grass can be found in the pools and pannes of the marsh. Eelgrass grows at the mouth of the creek. Unprotected. Small haOdwood forest on a gentle slope, facing Little Bay and bordered by a small stream which has deeply cut the bedrock, and falls over the ledge into the bay waters. Shagbark hickory, sugar and red maple, red and white oak and hophornbeam inhabit the rich and rocky soil. The underlaying rock is kittery quartzite which forms much of the Durham shore of the Great Bay. Very-large windthrown trees remain where they fell indicatigg the possibility that this may be a remnant of the forest that originally bordered much of Durham Point. A spectacular display of bloodroot and hepatica in early spring covers the forest floor with a colorful blanket. The cardinal flower, growing along the stream, gives color to the area during the summer months. A unique large 50 foot deep kettle hole, now an acid bog with a 60-80 foot pond occupying the center of a pronounced basin-like depression in a gravelly hill. A zone of pine and oak hardwood forest surroundsthe pond beyond a fringe of leather leaf and sphagnum mixed with other typical bog plants. Dwarfed and picturesque black spruce trees form an irregular and interupted fringing border around the bog mat. Several species of shrubs occur with the black spruce including witherod, mountain holly, high bush, blueberry and maleberry. A peripheral border zone lies between the spruces and the steep sides of the basin formerly this was heavily vegetated by the pines were cut several years ago the water level in.the bog has since been higher. Area is covered with a hardwood forest of many diverse species, and on the forest floor is a particularly interesting commun- ity of spring and summer wildflowers and ferns. This type of forest and there association is of rare occurence in New Hampshire east of the Connecticut River Valley. The three species which are Darticularly rare in Eastern N.H. are Miella Nuda, Blue Chosh and Spring Beauty. A more lengthy list of the unusual species has been prepared. Owned in part by UNH but awaiting protection status. Two very rare species nest here, the Goshawk and the red shouldered hawk.
